Welcome to PACK Health!  PACK Health, LLC (“PACK Health,”, “we,” “us,” or “our”) is glad that you are following your physician’s advice and have taken this step to improve your health.  Our PACK Kits and the assistance we provide in conjunction with the PACK Kits will provide information and tools that you can use in conjunction with the program prescribed by your physician or otherwise recommended by your physician or other party to learn more about your condition, how to take care of yourself, and how to monitor your success (collectively, our “Services”).  Our website (the “Website”), our mobile platforms and our Services are intended for use only as a supplement to, and not in place of, the care recommended by your physician.

This Privacy Policy explains the information that we collect about you and your health and the ways that we use that information and protect its privacy.  In addition to this Privacy Policy, we treat your “Protected Health Information” (as defined in the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations, as amended and supplemented from time to time (“HIPAA”)) in accordance with the requirements of HIPAA.  This Privacy Policy applies only to the Services provided by PACK Health.

In this Privacy Policy we us the term “Personally Identifiable Information” to mean any information about you that would allow a third party to determine your identity, and we use the term “Non-personally Identifiable Information” to mean any information that does not personally identify you, including, without limitation, “de-identified” data.

Information that You Provide to Us:

To order/activate your PACK Kit and allow us to provide you with the Services you have requested or elected to use, you provide us with your name, mailing address, email address, phone number, and prescribing physician’s name.  For some PACK Kits, we will also ask you for your birth date and gender so that we can attempt to provide you with the best recommendations. You may need to provide additional types of demographic information if you respond to a survey, test a particular product or service for us, or enter a contest or promotional event.  Health condition management programs (e.g., diabetes, hypertension, etc.) may view, access or contribute condition-related information to your account if you grant them permission to do so.  Devices, such as scales, blood pressure cuffs, glucometers, etc. may contribute data to your account directly through a manufacturer’s website if you grant them permission to do so.  Subject to your prior approval, our business partners may share information related to or recorded by the physical device you use with their services.  

Non-Personally Identifiable Information that We Collect:

PACK Health automatically collects certain technical information such as, without limitation, the Internet address from which you visit our Website, your browser type, which websites you were visiting before coming to our Website, which pages of our Website you visit and how long you visit each page.  In addition, if you use our mobile application, we will collect information about the mobile device you are using.  

Use of the Information:

We use your Personally Identifiable Information to determine your eligibility for Services, to provide the Services you have requested or elected to use and to tailor our Services for you, all in accordance with applicable law.  Those Services may include, without limitation, sending texts, emails, or regular mail or making phone calls to you to provide reminders, educational or technical information, or respond to your questions.  We may also use these methods to send you technical updates or notices regarding our Services or to improve our customer service.  We may also use your information to (i) investigate, prevent or take action regarding illegal activities, (ii) comply with applicable laws, regulations and legal process, and (iii) protect our rights, the rights of our affiliates or related third parties, or to take appropriate legal action to enforce our rights.

PACK Health may use your Personally Identifiable Information to inform you of other products or services available from PACK Health or our affiliates or business partners and in accordance with applicable law.  PACK Health may also contact you via surveys to conduct research about your opinion of current Services or of potential new Services that may be offered.

PACK Health compiles your Non-personally Identifiable Information in aggregate form to help diagnose problems with our servers and systems and to gather broad demographic information. We may additionally use aggregated, Non-personally Identifiable Information in the development of products and services to meet the continuing needs of our clients and customers, and to analyze and improve the content, features, materials and opportunities that we make available on our Website.

PACK Health may provide aggregated, Non-personally Identifiable Information to customers, advertisers and other third parties (including, without limitation, sponsors of research or product development and other business partners of PACK Health) including to generate reports, marketing and technical research and for related business purposes of PACK Health.  PACK Health may use Internet addresses for identification purposes only when necessary to enforce compliance with the PACK Health Website Terms of Use and to protect our Services or any person, as otherwise permitted by law.

As part of our business, we may provide aggregated Non-personally Identifiable Information, with or without compensation, to third parties for their own use.  The aggregated Non-personally Identifiable Information can be valuable in helping to develop new products or services that may be of interest to our customers.  The Non-personally Identifiable Information may include, without limitation, statistics about our customers, their use of the PACK Kits or results achieved through use of the PACK Kits.
